PULSE end user licence agreement and terms of use

  1. Agreement. By installing or using PULSE you agree to these terms on behalf of the organisation that administers the Atlassian site ("you"). Atlassian's Marketplace terms and the Atlassian Developer Terms also apply; where they conflict with these terms on matters of billing, refunds and the Marketplace, they prevail.
  2. Licence. We grant you a non-exclusive, non-transferable licence to use PULSE on the Atlassian sites on which it is installed, for the term of your subscription and in accordance with these terms.
  3. Price. PULSE is provided free of charge (decision D-029). Should a paid edition ever be offered, it would be billed through the Atlassian Marketplace on Atlassian's terms and these terms would be updated first. When a subscription lapses, PULSE degrades as described in the documentation and never destroys your data: configuration stays in your pages and can be used again on renewal.
  4. Your data. PULSE reads your Jira data as the viewing user and stores only what the privacy policy states, on your Confluence site. We do not receive, process or sell your data. The privacy policy forms part of these terms.
  5. Acceptable use. You will not reverse engineer, resell or sublicense PULSE, use it to build a competing product from its code, or use it to process data you have no right to process. [Whether per-person metrics may be derived from PULSE output is a policy question for you; PULSE computes none.]
  6. Intellectual property. PULSE, its code, design and documentation remain ours. Your data remains yours.
  7. Support. We provide support through the support page at pulse-delivery.pages.dev/support (email), best effort, normally within two business days.
  8. Warranty. PULSE is provided "as is". We warrant that it will perform substantially as documented; every number it shows is explained in its metric definitions, and where it cannot compute a number honestly it says so rather than estimating. To the fullest extent permitted by law we disclaim all other warranties, including fitness for a particular purpose. PULSE does not provide legal, financial or employment advice and its forecasts are statistical descriptions of past sprints, not promises.
  9. Liability. To the fullest extent permitted by law, our aggregate liability under these terms is limited to the fees you paid for PULSE in the twelve months before the claim, and we are not liable for indirect, consequential or special loss. Nothing limits liability that cannot be limited by law.
  10. Termination. These terms end when your subscription ends or when you uninstall PULSE. Uninstalling removes all PULSE storage from your site.
  11. Changes. We may update these terms with notice on the PULSE website; continued use after the effective date is acceptance.
